I. SUBJECT

Art. 1.

  1. These General Terms and Conditions govern the relationship between LALIV Ltd (“Лалив” OOD) (hereinafter the Seller, We) and natural persons – users of the online store at https://thelaliv.com (hereinafter the Website, Online Store, Client, User, You).

  2. When an order is placed through the Website, a distance sales contract is considered concluded within the meaning of the Bulgarian Consumer Protection Act (CPA).

  3. By using the Website, You agree to comply with these General Terms and Conditions.

III. DEFINITIONS

Art. 2. For the purposes of these General Terms and Conditions:
• User – any adult natural person who purchases goods from the Website for purposes outside their trade or professional activity.
• Business Client – any legal entity or professional who places an order for commercial purposes.
• Goods / Products – all items offered on the Website (including food supplements).
• Distance Contract – a contract concluded between the Seller and the User through the Website or other means of communication.

IV. CONCLUSION OF CONTRACT

Art. 3.

  1. The contract is considered concluded when the User places an order through the Website and receives confirmation by email.

  2. LALIV has the right to refuse to fulfill an order for objective reasons (e.g., lack of availability).

When placing an order, please make sure that you provide complete and accurate information. It is your responsibility to ensure that the order is correct and accurately reflects your choice. If the order is incorrect in any way, you must immediately notify us at contact@thelaliv.com.

V. PRICES AND PAYMENT

Art. 4. All prices are final and include VAT.

Art. 5. Payment of the ordered goods
Payment of the ordered goods can be made in two ways:

  1. Cash on delivery – cash payment to the courier upon delivery to a personal address or courier office.

  2. Debit/credit card payment – when submitting the order directly through our Website.

• For each ordered product, the User is obliged to pay the stated price, as well as delivery costs, unless it is indicated that delivery is free of charge.
• If you find that you have made a mistake in your order after we have sent an email confirmation, notify us immediately at contact@thelaliv.com. We will try to correct the errors, but it may not always be possible, although you may still have the right of withdrawal, as explained below.
• Orders delivered to an address outside Bulgaria may be subject to duties and other taxes. You are obliged to pay all customs duties and/or sales taxes applicable to your order.
• The product price indicated on our Website does not include delivery costs. All delivery costs will be clearly indicated before you select the product and during the checkout process.
• Please check in advance whether your card is activated by the issuing bank for online transactions.
• The transaction currency is Bulgarian Lev (BGN). Prices listed in other currencies are for informational purposes only and may differ from the actual amount charged to your card.
• Refunds of amounts paid by card are made only to the card with which the payment was made.

VI. PRODUCT SUBSCRIPTION DISCOUNT

  1. We may offer a “subscription” for certain products, under which you agree to automatically purchase one (or more) units of a selected eligible product during the corresponding subscription period (which you also choose). In return, LALIV Ltd will offer and finance a discount on the purchase of that product, which is applied at checkout. The discount level may vary between products and is indicated on the Website. Subscription periods may include monthly, quarterly, and/or annual options (each a “Subscription”). You may select multiple Subscriptions (i.e., for different products). You must have an account to purchase a Subscription.

  2. For example, if you choose a monthly Subscription for a product, we will automatically process and send you an order confirmation for the selected number of units each month, until you ask us to cancel that Subscription. By selecting a Subscription, you agree that your debit/credit card will be charged periodically (monthly, quarterly, or annually) at the product price stated on the Website at the date of automatic order generation, without further authorization from you.

  3. You may cancel the Subscription at any time:
    a) through your account at thelaliv.com; or
    b) by sending us a message at contact@thelaliv.com.
    If you have multiple Subscriptions and wish to cancel all of them, you must cancel each separately.

  4. Important: (a) we may increase product prices during the Subscription period, meaning you may pay a higher price than before. We will try to give you at least 7 days’ notice so you have the opportunity to cancel the Subscription; and (b) if you cancel a Subscription, it remains active until the end of your current subscription period. In both cases, you may exercise the right of withdrawal, as described below in clause 8, subject to the conditions and return criteria.

  5. We may change the availability and conditions of any Subscription. We will post the changes on the Website and notify you of price changes or other significant changes. We will try to give at least 7 days’ notice for price increases and at least 14 days for other changes, but this may not always be possible.

VII. DELIVERY

Art. 6.

  1. Delivery is carried out by courier (Speedy, Econt, or another partner).

  2. Delivery time: up to 14 business days for Bulgaria, up to 30 business days for the EU.

  3. Delivery costs are calculated at checkout, unless it is indicated that delivery is free of charge for the buyer.

Handover of goods

• The goods are handed over to the Client or to a third party who receives and confirms on behalf of the Client by signing the accompanying documents.
• If the Client is not found within the delivery period or does not provide access and conditions, LALIV is released from its obligation to deliver.
• The Client may confirm receipt after the deadline but bears the costs of re-delivery. In this case, a new delivery period begins.

VIII. RIGHTS AND OBLIGATIONS OF THE CLIENT

Art. 7. The Client has the right to:
• review the goods, their characteristics, prices, and delivery conditions;
• receive information about new goods and services;
• make electronic statements through the Website interface;
• be informed of their rights under the law.

Art. 8. The Client is obliged to:
• pay the price of the goods, services, and delivery costs;
• provide access and the possibility for receipt of the goods;
• provide up-to-date and accurate contact details. In case of incorrect data, LALIV is not responsible for non-performance.

IX. RIGHTS OF THE SELLER

Art. 9. LALIV has the right to:
• change prices without prior notice (all prices include VAT);
• require the price applicable at the time of the order;
• publish reduced prices by crossing out the old and indicating the new;
• notify the Client in case of lack of availability;
• refuse to fulfill an order if incorrect data has been provided by the Client.

Use of discount codes

  1. Discount codes can be used only for products that are not already discounted.

  2. Each discount code has a certain validity period. After its expiration, the code automatically becomes invalid and cannot be applied.

X. RIGHT OF WITHDRAWAL. RETURN OF GOODS

Art. 10.

  1. According to the CPA, the User has the right to withdraw from the contract within 14 days of receiving the goods.

  2. In case of withdrawal, the Client returns the goods at their own expense, unless otherwise agreed.

  3. The Seller refunds the amount within 14 days after receiving the returned goods.

Refusal of refund

LALIV has the right to refuse a refund if:
• the product is not in commercial condition, its packaging is damaged or missing;
• the product is a food supplement with broken/open packaging (Art. 57, item 5 CPA).

Claims

The Client has the right to refuse or request replacement if:
• the delivered goods do not correspond to the order;
• during transportation, the goods or packaging are damaged.

In such cases, the Client may choose:
• replacement with the same/similar product;
• refund within 14 days.

Return procedure in case of withdrawal, claim, or replacement

• The User uses the services of a courier we work with (e.g., Econt, Speedy, or another partner).
• The goods are sent to the address of the Seller indicated on the waybill (received with the initial shipment) or after contacting us via the “Contact Us” form, so we can provide the correct return address.
• Transport costs are borne by the User, unless the replacement is required due to the fault of the Online Store.
• If we cannot accept a returned product, we will contact you, and at your request, return it to you at your expense or keep it for collection.

Unless otherwise instructed, if you wish to return a product, please ensure that: you notify us in advance by email; the product is unopened and in its original packaging; you pack the product securely; you keep proof of dispatch; and you follow any other reasonable instructions from us.

XI. SMS SERVICE

Art. 11.

  1. The Client may receive SMS messages with order information, marketing offers, and promotions.

  2. The frequency of messages may vary.

  3. Unsubscription is possible via “STOP”, “КРАЙ”, “END”, etc.
    Fees and responsibilities: LALIV does not charge fees for SMS/emails. Possible charges by your mobile operator are at the Client’s expense.

USER CONTENT

  1. We may offer you the opportunity to upload/post content (including reviews). To protect us and all users, you agree that your content will not violate the Prohibited Uses clause below and confirm that you will be liable for damages we incur in case of non-compliance.

  2. We have the right to remove any content that, in our opinion, does not comply with these terms.

  3. We reserve the right to monitor and review content, but have no obligation to do so. You acknowledge that, unless expressly stated, the content has not been verified or approved by us.

  4. We are not liable to third parties for the content or the accuracy of content posted by you or other users.

  5. Any content you upload is considered non-confidential and non-proprietary. You retain ownership but grant us a worldwide, non-exclusive, transferable, royalty-free license (with the right to sublicense) to use, store, copy, adapt, make publicly available, translate, distribute, and otherwise use such content (in whole or in part) for the purpose of operating, improving, and promoting our website and our products.

  1. Our website and all other content on it are protected by copyright, trademark, patent, and/or other intellectual/property rights, which are reserved for “LALIV” Ltd and our licensors.

PROMOTIONAL VOUCHER TERMS AND CONDITIONS

  1. The following terms (“General Voucher Terms”) apply to all promotional vouchers and discount codes periodically issued by “LALIV” Ltd for use on our website, including promotional vouchers with a credit value (“Paycode vouchers”) and promotional discount vouchers (“Discount vouchers”). In these terms, “Vouchers” means Discount vouchers and Paycode vouchers.

  2. Individual Vouchers are also subject to additional terms (“Specific Terms”), which will be stated on the Voucher or at the time of its issuance.

  3. Vouchers may only be used for online orders through our website.

Specific terms for Discount vouchers
4. Discount vouchers must be used by the deadline stated on them and/or at issuance by entering the relevant code (“Discount code”), and expire after that date.
5. Upon reaching the fixed number of redemptions for a given Discount code (as specified in its terms), the code automatically expires regardless of the date.

General terms for all Vouchers
6. The right to use a Voucher is personal to the original recipient and cannot be transferred.
7. A Voucher may not be copied, reproduced, distributed, or published directly or indirectly in any form/medium for use by another person, or stored in a data retrieval system without our written permission. In particular, vouchers distributed without our approval (e.g., on internet forums/“deals” websites) are not valid and may be refused or canceled.
8. Unless otherwise stated in the Specific Terms:
a) Vouchers may not be combined with other vouchers/discounts/promotions;
b) each Voucher is valid for one-time use by the recipient;
c) each customer/household is limited to one Voucher per promotion/offer; and
d) the right to use is personal and non-transferable.
9. When you use a Voucher, you confirm that you are the authorized recipient and are using it in accordance with these terms, lawfully and in good faith. If we believe that a Voucher is being used in breach, unlawfully, or in bad faith, we may refuse or cancel it.
10. Vouchers cannot be exchanged for money.
11. We are not liable for any loss/claim arising from refusal/rejection/cancellation/withdrawal of a Voucher or the inability of a customer/household to use a Voucher for any reason.
12. We reserve the right at any time, at our discretion, to add to or amend these terms regarding Vouchers or to change/terminate the operation of a Voucher without notice.
13. All other terms for the use of our website also apply.

  1. PERSONAL DATA
    Art. 12. Personal data are processed in accordance with the Privacy Policy and the Cookie Policy of “LALIV”.

XII. APPLICABLE LAW AND DISPUTES
Art. 13. The provisions of Bulgarian law apply. Disputes are resolved amicably, and if impossible – by the competent court.
Clients may also use the EC platform for online dispute resolution: ODR.

XIII. INTELLECTUAL PROPERTY
Art. 14. All texts, logos, and trademarks on the Website are the property of “LALIV” Ltd. Copying them without written consent is prohibited.
